2.- INFORMATION AND CONSENT
In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, the “GDPR”), and any implementing regulations, by accepting this Privacy Policy the user provides their informed, explicit, freely given and unambiguous consent for the personal data provided through the MyStreetBook Platform to be processed by the Data Controller in accordance with the purposes set out below in this Privacy Policy.
3.- MANDATORY PROVISION OF DATA
The data requested in the registration form for accessing the Platform are, as a general rule, mandatory (unless otherwise specified in the relevant field) in order to fulfil the stated purposes.
Therefore, if such data are not provided or are provided incorrectly, the corresponding requests cannot be processed, although the user may freely browse the content of the Website.
4.- WHAT INFORMATION AND PERSONAL DATA DO WE COLLECT?
MyStreetBook collects information relating to the device used to access the Platform (such as device type, operating system, IP address and web browser), as well as browsing data generated during the use of the Platform (including pages visited, destinations consulted, searches performed, routes and points marked as favourites, and comments made), and geolocation data where this feature is enabled on the user’s device.
None of this information is linked to personal data that would allow the user to be identified, and it is used exclusively for statistical purposes, with MyStreetBook guaranteeing its anonymization.
The Platform includes sections and functionalities that can be accessed and used without registration. However, in order to access the full functionality of the application, the user must register, providing the following data:
- Identification data: username, first name, surname(s), address
- Contact data: email address
Once registered, users may access a private area where they can configure their profile and voluntarily provide additional information, including:
- Identification and contact data: phone number, address, gender, date of birth, nationality, identification document (ID, NIF, NIE, passport), profile image, social media profiles
- Browsing data
- Geolocation data (including GPS coordinates), subject to user consent
5.- PURPOSES OF DATA PROCESSING
The personal data collected through the Platform will be used for the following purposes:
- To manage user registration and access to the Platform
- To manage the information provided by users in each location, including location data (whether registered or not)
- To generate personalized itineraries and tourism recommendations
- To send periodic commercial communications, offers, promotions and updates related to the Platform
- To prepare anonymous statistical reports on user profiles, usage habits and activity on the Platform, including the use of profiling and segmentation techniques without identifying users
- To comply with legal obligations
- To analyse user preferences and behaviour to improve the service
- To respond to inquiries and requests
- To ensure system security and prevent misuse
6.- LEGAL BASIS FOR PROCESSING
The processing of personal data is based on:
- Performance of a contract: for the provision of the requested services
- User consent: for optional processing activities (such as analytics or advanced personalization)
- Legitimate interest: to ensure system security and improve service performance
Processing for user registration, management of locations and user-generated content is based on the consent provided upon acceptance of this Privacy Policy and, where applicable, on the performance of a contract, as such processing is necessary for the provision of MyStreetBook services.
Processing for newsletters, commercial communications and statistical analysis is based on user consent and, where applicable, on the legitimate interests of MyStreetBook. The user may object to such processing at any time.
7.- DATA RETENTION
Personal data will be retained:
- For as long as a relationship with the user exists
- For as long as necessary to fulfil the purposes described
- For the legally required retention periods
After this period, the data will be deleted or anonymized.
If the user withdraws consent, the services may no longer be provided.
8.- PROFILING AND AUTOMATED DECISION-MAKING
MyStreetBook uses automated systems to generate personalized itineraries and recommendations based on user preferences, behaviour and provided data.
This processing may involve profiling in order to deliver content tailored to the user’s interests.
However:
- No automated decisions are made that produce legal or similarly significant effects
- Profiling is used solely to improve user experience
The user may object to this processing at any time.
9.- COMMERCIAL AND PROMOTIONAL COMMUNICATIONS
One of the purposes of processing personal data is to send users electronic communications regarding offers, promotions, competitions and updates related to the MyStreetBook Platform.
Such communications will only be sent to users who have expressly consented to receiving them and have not objected.
In accordance with Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), users may unsubscribe at any time by sending an email to: msb@mystreetbook.es
10.- DATA SHARING WITH THIRD PARTIES
MyStreetBook does not sell or disclose personal data to third parties.
However, for the sole purpose of providing certain services (such as processing location data), personal data may be transferred outside the European Economic Area, including to service providers located in the United States.
In all cases, MyStreetBook ensures that such transfers are subject to appropriate safeguards in accordance with the GDPR.
11.- DATA ACCURACY
The user guarantees that they are of legal age and that the data provided are true, accurate, complete and up to date, and is responsible for any damages arising from failure to comply with this obligation.
Where data relating to third parties are provided, the user guarantees that such third parties have been informed and have authorized the processing.
12.- EXERCISE OF RIGHTS
Users may exercise their rights at any time, free of charge, by sending a request to MyStreetBook or by email to: msb@mystreetbook.es, attaching proof of identity.
Users have the right to:
- Withdraw consent
- Access their personal data
- Obtain confirmation as to whether their data are being processed
- Rectify inaccurate or incomplete data
- Request erasure of their data
- Request restriction of processing
- Request data portability
- Lodge a complaint with the Spanish Data Protection Agency (AEPD):

13.- SECURITY MEASURES
The Data Controller implements appropriate technical and organizational measures to ensure the security of personal data and prevent unauthorized access, alteration, loss or processing.
MyStreetBook processes data confidentially and complies with its duty of secrecy in accordance with applicable regulations.
14.- AMENDMENTS
This Privacy Policy may be updated to reflect changes in legislation or service activity. Users will be duly informed of any such changes.
